Tempur-Pedic Warranty Information

When purchasing a new Tempur-Pedic® mattress and/or flat foundation, rest assured that the investment is safeguarded by a 10-Year Limited Warranty (“Limited Warranty” or “Warranty”). This warranty stands valid for a decade post-purchase, promising replacement or repair of your mattress and/or foundation in case of any product defects. This commitment extends to all components of your product, with no deductible.

The warranty comes into effect when a product is purchased directly from Tempur-Pedic North America, LLC, or any authorized Tempur-Pedic retailer. I. WARRANTY DESCRIPTION

This Limited Warranty contains critical JAMS Arbitration Clause and Class Action Waiver provisions. By accepting the Warranty, you consent to forfeit your right to a court hearing, jury trial, and participating in a class action. Arbitration is mandated and is the only remedy for all disputes unless stated otherwise in Section VI. Thoroughly review the Dispute Resolution provisions in Section VI, which also explain your right to opt-out.

This Limited Warranty applies to any new Tempur-Pedic flat, non-adjustable foundation and/or Tempur-Pedic mattress (individually referred to as a “Product” or “Covered Product,” and collectively as “Products” or “Covered Products”) purchased within the United States, either from Tempur-Pedic (“we” or “us”) or its authorized retailers. The Limited Warranty is provided to you, the original buyer of the Covered Product (“you,” “your,” or “purchaser”) and is not transferrable to anyone who later purchases the product from you. The Limited Warranty terms are deemed accepted with your purchase of a Tempur-Pedic mattress and/or flat foundation product. This Limited Warranty confers specific legal rights to the purchaser, who might also have other rights varying from state to state.

II. DURATION OF THE WARRANTY

Tempur-Pedic assures that the Covered Product(s) will be free from defects in materials and craftsmanship under normal use for ten (10) years from the purchase date, as validated by your sales receipt (termed as the “Limited Warranty Period” or the “Warranty Period”).

III. COVERAGE AND LIMITATIONS

During the Warranty Period, Tempur-Pedic pledges to repair or replace defective Covered Products at no extra charge (except as mentioned below). Tempur-Pedic's obligation towards defective products is restricted to repair or replacement at Tempur-Pedic’s discretion, and this is subject to the limitations stipulated in this Limited Warranty. Any replaced parts and products under this warranty will become the exclusive property of Tempur-Pedic.

This Limited Warranty is exclusively applicable to the original purchase of new Covered Products directly from Tempur-Pedic or its authorized retailers. An “original purchaser” is defined as an individual or entity that buys the product directly from Tempur-Pedic or an authorized retailer, intending to use it for personal consumer use, not for commercial or industrial use or resale. An “authorized retailer” is an individual or entity explicitly authorized by Tempur-Pedic to sell Products directly to original purchasers. If a product is bought with the intention of resale, it is regarded as an “unauthorized reseller” transaction, and mattresses and/or foundations purchased from such entities will not be eligible for coverage under the Limited Warranty.

The Limited Warranty does not cover expendable parts, floor models, demonstration samples (unless specified otherwise in the “Mattress Demonstration Samples and Floor Models” section), or products sold by unauthorized resellers, including, but not limited to, unauthorized resellers on third-party websites.
