20-Year Diamond Mattress and Foundation Limited Warranty
Who Is Eligible for the Warranty?
Diamond Mattress provides this warranty only for the individual who originally purchased the mattress, either directly from Diamond Mattress or from an authorized retailer. This original purchaser is defined as the first individual to buy the mattress from either Diamond Mattress or an authorized dealer. The warranty becomes void if the original purchaser sells or gives up ownership of the mattress. Future owners accept the mattress in its current condition, with any and all existing flaws. A receipt, as proof of original purchase, should be retained.
Coverage Details
This warranty applies to mattresses manufactured by Diamond Mattress that have been purchased either directly from Diamond Mattress or an authorized retailer. It also extends to some covers sold with mattresses. The warranty covers defects in the material and workmanship of the mattress from the time of purchase for as long as the original purchaser owns and uses the mattress. This includes mattresses that have been replaced or repaired under the warranty. Any replaced or repaired mattress has the same warranty as the original mattress, with the warranty term beginning from the date of the original purchase.
What Defects Are Covered?
Diamond Mattress covers specific defects under this warranty. These include visible indentations greater than 1.5 inches not resulting from use of an inappropriate or unsupported foundation or bed base, physical flaws causing degradation, splitting or cracking of the foam material under normal use and handling, and manufacturing defects in the assembly of the mattress cover, with the exclusion of zippers and handles. A mattress must be continuously supported by a matching foundation or adjustable bed base, with a proper bed frame capable of supporting the collective weight of the mattress and user(s), to meet the criteria for normal wear.
Exclusions to the Warranty
The warranty does not cover any mattress that has been misused, neglected, used in violation of instructions, damaged, or subjected to accidents. This includes instructions to place the mattress on an appropriate bed frame. It does not cover normal increases in foam softness that do not affect the pressure-relieving qualities of the mattress, comfort preferences, defects resulting from physical abuse or damage to the mattress structure or cover material, color changes, peeling or wearing off of finishing treatments, or zipper breakage due to use or misuse. Furthermore, mattresses that are sold as “reconditioned,” “used,” “returned,” “previously owned,” or under similar conditions indicating that the mattress is not new or of first quality, or that it has been previously purchased or used by another consumer, are not covered by the warranty.
Remedies Provided Under the Warranty
If a defect as defined in this warranty is found, Diamond Mattress’ only responsibility and the original purchaser's only remedy is repair or replacement of the mattress. For the first ten years of ownership, Diamond Mattress will replace or repair the mattress free of charge. In years 10 to 20, Diamond Mattress will completely repair and re-cover the mattress, replace it, or offer a new mattress at 50% off, at Diamond's discretion. The only cost to the purchaser during this period will be transportation costs.
Other products from Diamond Mattress come with their own warranties. Diamond Foundations have a 2-year limited warranty. Diamond Pillows have a 2-year warranty. Diamond Sheets & Sleep Wellness Products come with a 1-year warranty unless specified otherwise. The warranty period for Diamond Mattresses is as specified on the law tag code.
How to Make a Warranty Claim
For a warranty claim to be valid, the mattress must be used on a firm, solid surface, like a bed base that can support the weight of the mattress and user(s) for its entire period of use. To make a claim, return your mattress or mattress cover and provide proof of the original purchase. In years 10 and beyond, you will be responsible for shipping costs both ways for replaced or repaired mattresses. These fees will be waived if Diamond confirms a defect in materials or workmanship. Diamond may allow you to provide photographic evidence of the defect instead of returning the mattress.
To file a warranty claim, send a photo of your law tag that is attached to the back of your mattress, a copy of your purchase receipt, and a description of the issues you are experiencing with your mattress to the Warranty Department.
Dispute Resolution
If a dispute arises out of this warranty, it will be determined and settled by binding arbitration between the parties, in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Arbitration will take place in San Francisco, CA, and it will not be combined with any other proceeding or arbitration against one of the parties. Arbitration must be sought for disputes arising out of this warranty before any rights or remedies are sought under Title I of the Magnuson-Moss Warranty Act.
Governing Law
The warranty will be governed by the laws of the State of California.
