2. Acceptance and Eligibility

ALL SUBSCRIPTION CANCELLATIONS ARE FINAL AND NON-REFUNDABLE after the initial 30-day money-back guarantee period. This means:
- No refunds will be issued for any unused portion of your current billing period
- No refunds for any prepaid periods beyond the current month
- Services will continue until the end of your current paid period
- Annual subscriptions cancelled mid-year receive no partial refunds
- The only exception is cancellation within the first 30 days of initial subscription
4.2 30-Day Money-Back Guarantee (Limited)

- NON-TRANSFERABLE: Credits cannot be transferred, sold, or redeemed for cash
- EXPIRATION: All credits expire 12 months from issuance date
- STACKING LIMITATIONS: Credits cannot be combined with other offers, promotions, or discounts
- EXCLUDED ITEMS: Credits cannot be used for delivery fees, protection plans, or subscription services
- NO CASH VALUE: Credits have no cash value and cannot be redeemed for cash

6. Service Availability and Performance

We strive to provide continuous service availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated via email at least 48 hours in advance when possible. Emergency maintenance may occur without notice.

Services are currently available in Los Angeles County and select surrounding areas. Service availability may vary by location and subscription type. Delivery services subject to geographic restrictions.
7. User Responsibilities

9.5 LA Mattress Protection Plan Terms and Conditions
SERVICE CONTRACT:
This LA Mattress Protection Plan ("Protection Plan") is a Service Contract between you (as the original purchaser and consumer) and LA Mattress provided by Los Angeles Mattress Stores ("L.A. Mattress").
The following types of mattresses are eligible for this Protection Plan: innerspring, gel-cool, foam, latex, air chamber, and adjustable beds.
- If a stain listed in the "WHAT IS COVERED" section occurs within the term of this Protection Plan, then this mattress Protection Plan ("Service") as outlined in the "SERVICE PROCEDURES" section of this Protection Plan.
- This Protection Plan is not a cleaning or maintenance contract, but rather a cure for your original manufacturer warranty.
- This Protection Plan is valid for a period of ten years ("the Term") from the delivery date of your new mattress.
- This Protection Plan covers accidental damage from handling, as listed in the "WHAT IS COVERED" section, of a new mattress up to a maximum $12,000 in retail value.
- This Protection Plan is only valid for a new mattress that was purchased at the same time as this Protection Plan, and appears on the sales receipt as such.
- This Protection Plan is non-transferable and not renewable.
- You must retain this Protection Plan and the sales receipt for both the mattress and this Protection Plan.
WHAT IS COVERED:
This Protection Plan provides Service for any of the following, except for what is listed in the "WHAT IS NOT COVERED" section of this Protection Plan:
Mattresses:
- Any food or beverage stain.
- Any human or pet bodily fluid stain.
- Any ballpoint pen ink stain from a specific incident.
- Any burn from a specific incident.
- Any puncture, cut, tear or rip caused in a specific incident or by a spring or coil, if the manufacturer's warranty previously covered that damage but has since expired.
REQUIREMENTS FOR REQUESTING SERVICE:
Failure to meet any of the following requirements can result in a denial of Service under this Protection Plan.
The mattress must have been delivered and installed soil-free and damage-free from the store where it was purchased. You must have performed all routine and preventative maintenance, as recommended by the manufacturer.
- Any stain must be reported to LA Mattress within five (5) business days of the date the stain occurred. Notify LA Mattress by calling (800)214-3578.
- If a spill occurs, simply blot with a clean, dry cloth. If you attempt to clean a spill, you must follow the cleaning methods recommended by the mattress manufacturer, which is to include not wetting any product in a hidden area.
- You must complete and return the Service Request Form to LA Mattress along with a copy of the sales receipt and a copy of this Protection Plan within 30 days after reporting your stain or damage.
- Foam and latex mattresses require the use of the Platinum waterproof mattress protector in order to qualify for any Service or benefit offered in the Plan. Other qualified mattresses must utilize any of the mattress protectors offered by LA Mattress Protection Plan to qualify for any Service or benefit offered in this plan.
If you need to purchase a replacement mattress protector due to normal wear and tear, please contact Los Angeles Stores for a replacement.
SERVICE PROCEDURES:
If LA Mattress determines that the reported stain or damage is covered under this Protection Plan, LA Mattress will perform one or more of the following:
- LA Mattress may provide a cleaning kit or advice on how to remove the stain.
- LA Mattress may dispatch an authorized technician to remove the stain or repair the damaged area.
- LA Mattress may replace the affected mattress. Pre-tax vary and furniture may fade over time, so replacements may not exactly match the color of non-replaced items.
- LA Mattress may provide for a store credit at an amount equal to the original purchase price of the affected mattress. Your Reselection store credit is only valid for new fabric color notification by L.A. Mattress.
- Replacement or Reselection, will complete your coverage on this Protection Plan on the mattress. Replaced or Reselected mattress is not eligible for a new LA Mattress Protection Plan.
MATTRESS PROTECTOR SERVICE PROCEDURE:
- If a spill occurs, quickly machine wash and dry the mattress protector according to the instructions of the wash and care label on the protector.
- If the stain remains after washing, or the mattress protector is accidentally damaged by a puncture, cut, tear, rip, or burn, call L.A. Mattress at (800)214-3578.
- L.A. Mattress will replace your mattress protector up to 3 times under the terms and conditions of this Protection Plan.
WHAT IS NOT COVERED:
This Protection Plan does not provide Service for any of the following:
General
- Any stain or damage that is not specifically listed under the section titled "WHAT IS COVERED"
- When the actions listed in the "REQUIREMENTS FOR REQUESTING" have not been followed
- Any stain or unknown origin or accumulation of stains, damage or soil buildup (including perspiration) that will typically have been more repeated use rather than from a particular incident
Negligible Mattresses & Components
- Mattress used with stains or damage prior to delivery ("as is")
- Corrosion from Metal (COM) items
- Non-colorfast fabrics (fabric that loses color when cleaned according to the manufacturer's instructions)
- Box springs and mattress handles
Improper Maintenance, Care or Misuse
- Stains on mattresses that have not been properly cared for or maintained, as per your manufacturer's warranty
- Stains resulting from the improper use or misuse of the mattress, including the use of the mattress against the purpose for which it had been intended
- Stains caused by or resulting in mold or mildew
- Stains including color loss or color change, resulting from washing methods other than those recommended by the mattress manufacturer
- Stains caused by animals, except pet bodily fluid listed in the section titled "WHAT IS COVERED"
- Any stain due to reasonable wear and tear, unless considered preventable occurrences and will not be covered by LA Mattress
- Stains due to excessive activities, including, but not limited to cuts, tears, runs, and risk, paint, cigarettes, or stains
- Mattresses that show signs of infestation, including, but not limited to, insects, termites, bedbugs, and moths
Manufacturer Quality Issues
- Stain reactions (as upholstery seam that comes unstitched or unglued), stress tear (tearing or ripping of upholstery within one-half inch of and parallel to the seam), piling or fuzzing
- Failing, color loss or color change
- Loss of foam and/or innerspring resiliency (manufacturer's warranties)
- Damage resulting from defects in design, materials or workmanship, except for damage specified in "WHAT IS COVERED" section
- Stains or damage that occur while the mattress is not located within your residence
- Stains or damage that occurs after the mattress is no longer in your possession (e.g., from moves or between residences)
- Mattress that is, or has been, used for commercial, institutional, or rental purposes, including daycare
Not Covered By Repeated Use (over time)
Damage caused by wear, such as but not limited to, including:
- Soiling or other surface abrasions
- Pilling or matting of fabric
Miscellaneous:
- Odors
- Stains or damage covered under any manufacturer's warranties, or under any homeowner's, renter's, or other insurance policy
- Stains or damage caused by appliance malfunctions, including, but not limited to, skylights, roofs, or water pipes
- Stains or damage caused by appliance malfunctions, including, but not limited to, air conditioners and water heaters
- Stains or damage caused by fire, smoke, flood, or other natural disaster
- Stains or damage caused by theft, vandalism, or as a result of any other illegal activity
- Stains or damage caused by independent contractors, such as, but not limited to, maintenance personnel, painters, or other repair or maintenance services
10. Intellectual Property
All content, software, designs, and materials provided through our subscription services are protected by intellectual property laws and remain property of LA Mattress Store or our licensors. You receive a limited, non-exclusive, non-transferable license to use our services for personal, non-commercial purposes only during your active subscription.
11. Disclaimers and Limitation of Liability
11.1 Service Disclaimer
Subscription services are provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
11.2 Limitation of Liability
To the maximum extent permitted by law, our total liability for any claims related to subscription services shall not exceed the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility.
11.3 Specific Exclusions
LA Mattress Store is not liable for:
- Damage resulting from failure to report initial stains or defects immediately
- Service interruptions due to customer relocation outside service area
- Damage from improper use, care, or maintenance of products
- Normal wear and tear or gradual deterioration
- Damage from acts of nature, accidents, or misuse
- Consequential damages from delayed or missed service appointments
- Loss of store credits due to expiration or terms violations
- Benefits unavailable due to geographic restrictions
12. Dispute Resolution
12.1 Binding Arbitration Agreement
PLEASE READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS: Any dispute arising from these Terms or our services will be resolved through binding individual arbitration rather than in court, except for small claims court matters under $10,000. This includes disputes about the validity of this arbitration agreement.
12.2 Class Action Waiver
CLASS ACTION WAIVER: You agree to resolve disputes with LA Mattress Store individually and waive any right to participate in class action lawsuits, class-wide arbitrations, or representative actions. This waiver is an essential part of our arbitration agreement.
12.3 Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. For any disputes not subject to arbitration, exclusive venue shall be the state or federal courts located in Los Angeles County, California.

13.1 SMS Program Consent and Enrollment
By providing your mobile phone number during subscription enrollment and checking the SMS consent box, you expressly consent to receive automated text messages from LA Mattress Store (msg&data rates may apply):
